Plain-language summary
Open Road Strategies is an Oklahoma personal injury lead generation platform. We are not a law firm and we do not provide legal advice. We connect injured people with vetted partner law firms, and we sell qualified case referrals to those firms.
This summary is provided for convenience and orientation only. The full terms below govern your use of this website and our services.
01Who we are
Open Road Strategies is a personal injury lead generation platform that operates throughout Oklahoma. The platform is operated by Auctus LLC. References to “Open Road Strategies,” “we,” “us,” or “our” in these Terms and Conditions (“Terms”) refer to that operating entity.
Open Road Strategies connects people who have been injured in Oklahoma roadway incidents with a limited network of vetted partner personal injury law firms. We focus on motor vehicle and motorcycle accidents, semi and commercial vehicle accidents, wrongful death claims arising from crashes, and catastrophic injury matters.
Open Road Strategies is not a law firm, a lawyer referral service operated by a bar association, or a legal services provider. We do not represent claimants, we do not appear in court, and we do not handle claims. Our role is limited to capturing inquiries, screening them against criteria, and routing qualifying matters to a partner law firm.
02No legal advice or attorney relationship
Nothing on this website or communicated through our intake process is legal advice. Information presented here is general and is intended for marketing and intake purposes only. It is not a substitute for advice from a licensed Oklahoma attorney about your specific situation.
Using this website, submitting a form, speaking with our intake team, or being matched with a partner law firm does not create an attorney-client relationship with Open Road Strategies. An attorney-client relationship is formed only if and when a partner law firm agrees in writing to represent you. Any deadline, statute of limitations, or legal question that affects your rights should be confirmed directly with a licensed attorney.
03Acceptance of these terms
By accessing this website, submitting an inquiry, requesting a call, or otherwise using our services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website or our services.
If you are using our services on behalf of a law firm or other organization, you represent that you are authorized to accept these Terms on that organization’s behalf.
04Who these terms cover
These Terms apply to two groups of users, and certain sections are written specifically for one group or the other.
- Injured claimants. Individuals in Oklahoma who have been injured in an accident and are seeking information about, or a connection to, personal injury legal representation.
- Partner attorneys and law firms. Plaintiff-side personal injury law firms that have entered into, or are evaluating, a partnership arrangement to receive qualified case referrals.
Where a section is addressed to one group, that section governs that group’s use of the services. General sections apply to everyone.
05What the platform does
Open Road Strategies captures inquiries from injured people, screens those inquiries against agreed criteria, and routes qualifying matters to a partner law firm. Screening considers factors such as case type, the location of the incident within Oklahoma, the time since the accident, basic liability and injury information, and the person’s interest in speaking with counsel.
Matters that qualify are delivered to a partner firm as a live transfer or as a vetted form lead, together with an intake summary and, where applicable, a call recording. Matters that do not meet the agreed criteria are not routed.
We do not control, supervise, or direct the legal work of any partner law firm. The decision whether to accept, decline, or pursue any matter rests entirely with the partner firm and, where representation begins, with that firm and its client.
06For injured claimants
For injured claimants
Our service is free to you
There is no cost to you for submitting an inquiry or being connected with a partner law firm. We do not charge claimants any fee at any point.
What a match means
Being matched with a partner law firm is an introduction, not legal representation, and not a guarantee that any firm will take your case. The partner firm independently evaluates your situation and decides whether to offer representation. Any fee arrangement is made directly between you and the firm you choose.
Accurate information
Please provide accurate and complete information during intake. Screening and matching depend on it, and inaccurate information may delay or prevent a useful connection.
Your deadlines are your own
Personal injury claims in Oklahoma are subject to time limits. We do not calculate, advise on, or guarantee any deadline that applies to you. Confirm any deadline that affects your rights with a licensed Oklahoma attorney as soon as possible.
07For partner attorneys
For partner attorneys
Scope of the arrangement
Partner firms receive qualified case referrals on the terms set out in a separate written partnership agreement. Where that agreement and these Terms differ, the partnership agreement controls for matters between Open Road Strategies and the partner firm.
Exclusivity and matching
Each qualified matter is matched to a single partner firm based on case type and Oklahoma geography. Where multiple partners qualify for a category, matters are distributed on a round-robin basis as described in the partnership agreement.
Professional responsibility remains with the firm
The partner firm is solely responsible for its own compliance with the Oklahoma Rules of Professional Conduct and Oklahoma Bar Association advertising and solicitation rules, for any required disclosures, for conflict checks, and for its independent evaluation and handling of every matter. Open Road Strategies does not provide legal services and does not direct the firm’s representation of any client.
No guarantee of volume or outcome
We do not guarantee a specific number of leads, a conversion or signing rate, case value, or any litigation or settlement outcome. Performance depends on many factors outside our control, including market conditions and the firm’s own intake and case handling.
Fees and payment
Fees, billing, credits, and any return or replacement policy are governed by the partnership agreement. Referral fees are structured as a fixed platform fee for qualified case referrals and are not contingent on, or a division of, any legal fee recovered by the firm.
08Communications and TCPA consent
By submitting an inquiry or providing your phone number, you consent to be contacted by Open Road Strategies and by the partner law firm matched to your inquiry, by phone call, text message, and email, at the number and address you provide. This may include the use of automated or assisted dialing technology and prerecorded or artificial voice messages for intake and follow-up purposes.
Consent to receive calls or texts is not a condition of any service, and message and data rates may apply. You can opt out at any time by replying STOP to a text message, by asking not to be contacted during a call, or by using the contact details in Section 19. Opting out with us does not opt you out of communications from a partner law firm, which you should contact directly.
Calls may be recorded for quality, training, and intake-documentation purposes. Where a call is recorded, you will be notified at the start of the call, and continuing the call indicates your consent to the recording.
09Personal information and data handling
Open Road Strategies does not sell claimant personal information, and we do not retain claimant personal information in our systems as a long-term record. When an inquiry qualifies and is matched, the intake details are transmitted to the matched partner law firm through encrypted messaging so that the firm can evaluate and, if appropriate, contact you.
Once a qualifying matter has been transmitted to the matched partner law firm, the partner firm becomes responsible for that information under its own privacy practices and professional obligations. You should review the partner firm’s privacy practices directly.
Our handling of information is described more fully in our Privacy Policy, which forms part of these Terms. To the extent there is any conflict between this section and the Privacy Policy, the Privacy Policy controls on data matters.
10Eligibility and geographic scope
The services are intended for use in connection with personal injury matters arising in Oklahoma and for users located in Oklahoma. You must be at least eighteen years of age, or have the authority of a parent or guardian, to submit an inquiry. We may decline to provide services, or to route any matter, for any lawful reason.
11Disclaimers and no guarantees
The website and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Open Road Strategies disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that any inquiry will result in a connection to a law firm, that any law firm will accept a matter, or that any legal claim will succeed. We make no representation about the merits, value, or likely outcome of any potential claim. Statistics, examples, and general information shown on this site are illustrative of how the platform works and are not predictions about any individual matter.
12Limitation of liability
To the fullest extent permitted by Oklahoma law, Open Road Strategies and Auctus LLC, and their owners, members, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or legal rights, arising out of or relating to your use of the website or services, even if advised of the possibility of such damages.
Where liability cannot be excluded, our total aggregate liability arising out of or relating to the services is limited, for claimants, to one hundred dollars, and for partner firms, to the amount of fees paid by that firm to Open Road Strategies in the three months before the event giving rise to the claim.
13Indemnification
You agree to indemnify and hold harmless Open Road Strategies, Auctus LLC, and their owners, members, employees, and agents from any claim, loss, liability, or expense, including reasonable attorneys’ fees, arising out of your breach of these Terms, your misuse of the services, or, in the case of a partner firm, its handling of any matter or its compliance obligations as a law firm.
14Intellectual property
The Open Road Strategies name, logo, brand marks, website content, and platform design are the property of the operating entity and are protected by applicable law. You may not copy, reproduce, or use any of these without prior written permission, except as needed to use the services as intended.
15Third-party links and services
The website may link to or rely on third-party services, including partner law firms and technology providers used for telephony, messaging, and analytics. We are not responsible for the content, practices, or services of any third party. Your dealings with a partner law firm are solely between you and that firm.
16Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the website or services after a change takes effect means you accept the updated Terms.
17Governing law
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law rules. Subject to Section 18, the state and federal courts located in Oklahoma County, Oklahoma have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the services.
18Dispute resolution
Before filing any claim, you agree to first contact us using the details below so that we can try to resolve the matter informally. If a dispute cannot be resolved within thirty days, the parties may pursue available remedies as provided by Oklahoma law. [If the company elects to require binding arbitration or to include a class-action waiver, that language should be added here and reviewed by counsel.]
